About the Author
Lisa Guerin, an editor/author specializing in employment law, is author or co-author of several Nolo books, including The Manager's Legal Handbook, Dealing with Problem Employees, Nolo's Essential Guide to Federal Employment Laws, Workplace Investigations, Create Your Own Employee Handbook, and Nolo's Guide to California Law. Guerin has practiced employment law in government, public interest, and private practice where she represented clients at all levels of state and federal courts and in agency proceedings. She is a graduate of Boalt Hall School of Law at the University of California at Berkeley.

Tough subject handled well - typical NOLO "must have"

Typical for a Nolo book, you get a well organized, more-than-a-layperson and less-than-a-lawyer view of the relevant issues. This is a review of the second edition of this book, published two years after the first, which includes an additional 20 pages. It starts with a general overview of why you might need such policies in the first place. The rest of the book coherently carves out the role of specific technologies in the workplace including e-mail, camera phones, and company social media sites. Chapter 7, "Company-sponsored Social Media," was extremely relevant as my organization has just established a Facebook site. This chapter is now must reading by our Facebook committee members.

All chapters include an overview of the specific technology, and its general and unique issues. This is followed by extended discussion with numerous examples. A sample policy is always listed at the end of each chapter. In my organization's case, most of the policies would be overkill. However, it's far easier to remove provisions you don't need, than to add ones you don't know exist. All of the sample policies are included on a CD-ROM and make excellent leaping off points for developing your own documents. Policies on the CD-ROM are in rich text format (rtf).

The chapters are liberally sprinkled with "Lessons from the Real World," examples of actual legal action relevant to a specific technology. For example, in Chapter 7 one can read about "Defamation in 140 Characters or Less" (page 144) where we are regaled with what the author claims may be "the first Twitter lawsuit." Courtney Love was served with legal papers for calling fashion designer Dawn Simorangkir "a prostitute, drug addict, and 'nasty lying hosebag thief.' " Indeed.

Copies of this book should probably go to the CEO, CIO, and head of HR. Also good for general reference collections in libraries.

This is a really tough subject area handled really well. Due to the ongoing changes in all things internetty I would expect to have to regularly buy new editions, or avail myself of the free legal updates posted at Nolo.com.

Very helpful for the businessperson who wants to be protected

Most small and medium sized business owners can't afford adequate legal representation on a day-to-day basis. On the other hand, all businesses have intellectual property (IP) and other assets they would prefer to protect. By nature, business owners also want to protect themselves from liabilities that have the potential of destroying their business and perhaps even personal wealth.

Add to this the fact that most smaller businesses are under-insured and the legal environment and you have the makings of potential disaster on several fronts. Things like an employee using a bootleg copy of a software program can land you in big, expensive trouble.

For $20, "Smart Policies for Workplace Technology: Email, Blogs, Cell Phones & More" gives the small and medium sized business owner a leg up.

There is a need in every business to have your employees feel as if they are trusted - the key is to trust enough, but not too much. Self-protection is the key.

Author Lisa Guerin is an attorney and she knows her stuff. (I can offer a kind of informed opinion here because many of the projects I work on are related to employment law and intellectual property - the very things discussed in this book.)

Much to her credit, Guerin describes the issues in easy-to-understand language.

She begins by explaining why businesses need policies governing the use of the company's technology. (To a large extent, the advice is applicable to any organization. In order to keep my language simple, I will simply use business or businesses.) Most importantly, she emphasizes not only that businesses need policies, but that employees must sign a statement that they understand and agree to abide by them.

Guerin does a good job, in my estimation, of explaining the dangers businesses face as a result of misuse of business technology by employees. She covers computers and software, email, internet use, instant messaging, blogging, cell phones, portable computing devices, cameras and camera phones.

Each chapter contains some solid "scary" examples of what can happen when you don't have policies in place - and some encouraging cases showing the results of smart management. Guerin is convincing.

Her explanations are clearer than I would have expected and either she has done her research well or has a competent staff.

From my own experience, I believe owners and managers of small to medium sized businesses would greatly benefit from not only reading this book, but following its advice. (There's a CD filled with sample forms to help the reader along.) I have been involved in a number of projects where departing employees helped themselves to customer lists and other proprietary information; an instance where an employee used his cell phone camera to photograph top-secret designs; and where misuse of company computers put the business in legal jeopardy.

It's a cruel world out there. Employees can harm their employers, intentionally or otherwise. Lots of lawyers make good livings suing companies - and increasingly they know how to use people like me to find evidence in the information technology infrastructure.

Overall, this is a book every employer should read and heed.

Easy to read volume for HR Directors and Small Business owners

While I usually review CDs and DVDs as well as entertainment related books here on Amazon, I do work in management in a office environment and so this book was of interest to me.

It is another in the fine line of legal books - written in plain English - by Nolo Press. I've been reading their books for more than 30 years.

This particular volume is the 2nd Edition. The original was published in 2009 and this is the 2011 version. It's not clear what parts have been updated or revised. Many of the surveys mentioned took place on 2009 or earlier. But if you don't have the first edition, this info will be all new to you.

The author - an attorney with lots of employment law experience, makes you feel at ease as a reader, right from the start. But she also gives you cause for concern as she discusses formal policies for PC use, cell phone use and personal email abuse. As you learn by reading the sections marked "Lessons from the real world" placed throughout the book, lawsuits abound.

The book is probably of most use by HR directors or owners of small companies. At just over 200 pages with large type and plenty of white space the book can be read from beginning to end in one or two sittings. It comes with a handy CD-ROM (inside back cover) that contains lots of sample forms.

I would certainly recommend it to the individuals I noted above. It's - as I said - an eady read and it could easily save you from a possible lawsuit.
